TERMS AND CONDITIONS OF USE

The content and use of BUEN TAXI is subject to the conditions set forth herein. Persons hereinafter Citizen-Users by accessing, browsing or using this application, acknowledge that they have read, understood and agree to comply with these terms, laws and regulations, the user of this site, is requested to read in detail and judiciously these conditions of use and the Security and Privacy Policy of the system by entering the website in the section of data privacy policies. If the Citizen-User does not agree with this privacy policy, we suggest that he/she refrain from using this application. 

1. Treatment of your personal data

INNLAB S.A.S is RESPONSIBLE for the processing of personal data of the User and informs you that these data will be treated in accordance with the provisions of the Law on Protection of Personal Data or Law 1581 of 2012, Decree 255 of 2022, Article 2 °, 3, 4,5, 6,7,16 of Law 1266 of 2008, Decree 1377 of 2013, art 15 of the Political Constitution of Colombia.

2. Collection of personal data

2.1 Buen cab may collect the following personal data:

i. Personal Information

The User will have the option to provide email, name and phone number to access some of the services of Buen cab. 

Buen Taxi collects such information in compliance with personal data processing and security laws. User may not have access to some Buen cab services if User chooses not to share such information.

ii. Location

Buen cab will obtain the user’s location information in the foreground (application in use) through the geolocation of the IP address of the user’s device only in the case of using the ride-quoting feature to provide a more accurate and higher quality service.

iii.  Rating Information

The User may rate the service provided by the driver anonymously against the driver.

iv Rating Status

Buen Taxi may record the status of the User’s ratings. Buen cab will obtain such information in accordance with the laws of personal data processing, in order to have evidence in case of disputes.

v. Service to third parties

Buen Taxi will collect the ratings and data provided by the user and share them with the third party providing the services, for the realization of educational programs and improvement of the quality of the service.

2.2 Third Party Information

BUEN TAXI contains data from other persons or entities, but is not responsible for their content, does not control, endorse or guarantee the content included in such data, nor is it responsible for the operation or accessibility of the linked cab companies; nor does it suggest, invite or recommend them, so it shall not be responsible for the result obtained, including changes or updates made by the cab companies or the accuracy or completeness of the information provided therein.

Consequently, Citizen-Users accept that CORPORACIÓN INNLAB S.A.S is not responsible for any content, data of persons or entities, resource or service associated to the site of a third party, nor will it be responsible for any loss or damage of any kind arising from the use made of the services of third parties.

3. Storage of personal data

They will be kept for no longer than necessary to maintain the purpose of treatment or there are legal requirements that dictate their custody and when no longer necessary for this purpose, they are deleted with appropriate security measures to ensure the anonymization of data or the total destruction of the same.

4. Data Analysis

4.1 The data collected by the application are treated confidentially to achieve the following purposes:

i. To provide information and process complaints or any type of request made by the user through the application.

ii. To carry out statistical analysis and studies of the sector.

iii. To send informative bulletins on the quality of the cab service provision. 

iv. Collect base information for educational programs and pedagogical sanctions to strengthen the quality of the cab service in the city of Santa Marta.

v. Sending commercial advertising communications by e-mail, fax, SMS, MMS, social communities or any other electronic or physical means, present or future, that enable commercial communications. These communications will be made by the responsible and related to their products and services.

5.Rights and prohibitions of the Citizens – Users

5.1 The rights of the USER are:

– Calculate the value of the race 

-To qualify the service 

-To know who is driving you

-To share the data of the cab and the driver who mobilizes you 

-Choose the language 

-Right of access, rectification, portability and deletion of your data, and to limit or oppose its processing.

-Right to file a complaint with the supervisory authority, the Superintendence of Industry and Commerce (www.sic.gov.co) if you consider that the treatment does not comply with current regulations.

5.2 The Citizen-User agrees to :

Not to introduce in the mobile application, information of offensive or offensive character or containing threats, or other harmful programs or mechanisms to capture or distort information contained in the application. In addition, you may not upload, post, email, transmit or otherwise provide unlawful, harmful, abusive, hostile, defamatory, discriminatory, vulgar and libelous content, or upload content that may cause difficulties in the operation of the system of this application. The User-citizen shall refrain from making false or otherwise erroneous statements of his or her affiliation with a natural or legal person or storing personal data.

6. Compulsory or optional nature of the information provided by the user

The USERS, by checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form, expressly and freely and unequivocally accept that their data are necessary to address their complaint about the cab service provided by the provider, being voluntary the inclusion of data in the remaining fields. The USER guarantees that the personal data provided to the RESPONSIBLE are truthful and is responsible for communicating any changes to these.

The RESPONSIBLE informs that all data requested through the website are mandatory, as they are necessary for the provision of an optimal service by BUEN TAXI to the USER. Failure to provide all the data will not guarantee that the information and services provided will be completely tailored to your needs.

7. Acceptance of the terms

The provision of the service of the Buen Taxi Application is free and free of charge for Users and its data processing policy is governed by the terms and conditions of Law 1581 of 2012, which are understood as known and accepted by the Citizen-Users of the site. The use of the user’s personal data is subject to the Personal Data Protection Policy of the Ministry / Single Fund for Information Technology and Communications.

INNLAB S.A.S reserves the right to unilaterally revise and modify these terms and conditions of use or the information contained in the application at any time without notice by updating this announcement. It may also make improvements or changes in the services described in this application at any time without notice.

8. Use of the System by Minors

Minors under 18 years of age or incapable shall not enter or use the services provided by the application without the prior consent of their parents, guardians or curators. Users under 18 years of age or incapable may not register on their own to access the services provided by the application, but only with the consent of their parents, guardians or conservators, as appropriate.

Buen Taxi states, in accordance with the provisions of the Code of Minors or applicable laws, that the purpose of the application is not to violate the morals, physical or mental health of minors or incapacitated persons, or obtain confidential and intimate information of the user for the purpose of using it against them. The parents, guardians or curators of the underage or incapable user are fully responsible for the use that the underage or incapable user makes of the platform.

9. Copyrights

INNLAB S.A.S. owns all rights to the software of this application, as well as the intellectual property rights and commercial exploitation of the contents included in it, and reserves all copyrights, including those not mentioned in this document.

The intellectual property on the contents of the mobile application (text, graphics, logos, animations, sounds and databases, among others) are either part of the assets of INNLAB SAS or, where appropriate, its ownership belongs to third parties who authorized the use of these on the website or is public information that is governed by the laws of access to Colombian public information. The texts and graphic elements that make up the mobile application, as well as its presentation and assembly are the exclusive property of INNLAB S.A.S and it holds the necessary exploitation rights.

Some of the materials in this mobile application may be protected by copyright when so mentioned in the content. Therefore, any unauthorized use, as well as non-compliance with the terms, conditions or notices contained therein, may violate the national regulations in force in this regard.

In any case, BUEN TAXI will make reference to the official sources of these images when using them.

10. Legal Notice

INNLAB S.A.S, reserves the right to modify, supplement or suspend all or part of the application and the content generated by the use of the application. Additionally, it reserves the right to change the terms and conditions of use of the data at any time, effective immediately from the time the application is updated. It will be considered that the Citizen-User has read and accepted the terms and conditions of use to use, access, download, install, obtain or provide information to the application for this reason the Citizen-User declares that he/she is aware that the personal data inserted in the applications is the sole responsibility of each of the entities that publish it.

 The use that the Citizen-User makes of the mobile application is under his/her sole responsibility and all responsibility for the availability, timeliness, security and quality of the related application or other products, services and information obtained through the application is disclaimed. The personal data of third parties or companies included in the application are not under the control of INNLAB S.A.S., so it is not responsible for the content or linked data.

11. Privacy Notice

In accordance with the provisions of Article 15 of the Political Constitution of Colombia and the duties contained in Law 1581 of 2012 or the rules that modify, repeal or subrogate them, INNLAB S.A.S, adopts the policy of treatment of personal data of BUEN TAXI, in order to protect the privacy of personal information you have or come to obtain through this, as well as preserve the confidentiality, security, accuracy, transparency, access and restricted circulation of this information that rests in their databases.

By using BUEN TAXI services, the Citizen-User acknowledges and agrees that this site may access and preserve his/her contact information, as well as disclose any content associated with such data, if necessary for legal reasons, or if it is deemed in good faith that access, preservation or disclosure of such data is reasonably necessary to: (a) comply with applicable laws, regulations, legal process or enforceable governmental requests, (b) enforce the Terms, including investigation of potential violations thereof, (c) detect, prevent or otherwise address instances or situations of fraud, security or technical issues (including, without limitation, spam filtering) or (d) protect against any imminent harm to the rights, property or safety of BUEN TAXI, its Users and the public as provided or permitted by law.

BUEN TAXI informs the Citizen-User that the information requested and provided freely and voluntarily by the User is for the purpose of keeping a record of citizen participation, the future delivery of information related to Buen Taxi and to send notifications of updates according to the interests indicated by the user at the time of downloading.

BUEN TAXI, reserves the right to modify the Privacy and Data Protection policies detailed below in order to adapt them to new legislative, jurisprudential, technical requirements or all those that allow you to provide better and more timely services and information content, so it is advisable to review these rules periodically.

12. Security and data protection policy

INNLAB S.A.S through the Mayor’s Office of Santa Marta collects information in accordance with the provisions of Law 1712 of 2014 in relation to reserved and classified information. It is possible that the information we collect in our system (for example: the user’s name, searches performed, location and duration of the user’s session) are combined to statistically analyze the traffic and level of use of the application. This information is collected to improve the performance of our platform.

In those cases in which the Citizen-User publishes freely and voluntarily in the application any additional information to that requested that has the character of classified, it will be understood that he/she has consented to the disclosure of this in the terms indicated in article 18 of Law 1712 of 2014. In the same sense, if the information that is published by the entity is subject to reserve or classified, Users must make the respective claims before the Ministry in the terms indicated in Law 1712 of 2014.

BUEN TAXI uses cookies to preserve session information and save browser characteristics. Cookies are not used to access personal information or to monitor your actions. Cookies used by Buen Taxi are files sent to a browser by a web server to record the user’s activities in the application and allow a more fluid and personalized navigation. The user has the ability to configure your browser to prevent the entry of these, block them or, if necessary, delete them. To use this application, it is not necessary for the user to allow the download or installation of cookies.

12.1 Information security policy

BUEN TAXI has information security measures in the processes, procedures, services, information systems and its infrastructure to preserve the confidentiality, integrity, availability and privacy of the data and information managed in this, and in compliance with the corresponding legal framework, in order to provide a reliable experience, through a secure service.

That in accordance with the provisions of the current regulations on personal data protection, the RESPONSIBLE is complying with all the provisions of the Law for the processing of personal data under its responsibility, and manifestly with the principles described in Article 4 of Law 1581 of 2012 , by which they are treated lawfully, fairly and transparently in relation to the data subject and adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The RESPONSIBLE guarantees that it has implemented appropriate technical and organizational policies to implement the security measures established by Law 1581 of 2012 in order to protect the rights and freedoms of the Users and has communicated the appropriate information to them so that they can exercise them.

In BUEN TAXI we check and test all stages of the development life cycle of this (Development, Testing, Production) and perform constant evaluation of the same, in compliance with the Digital Government Strategy (Decree 1008 of 2018) and the National Digital Security Policy (CONPES 3854) in order to analyze the digital security risks to which the application is exposed and achieve its proper mitigation.

We are not responsible for any failure in security measures when such failure is due to circumstances beyond our control, fortuitous event or force majeure.

INNLAB S.A.S through BUEN TAXI, is committed to adopt a policy of confidentiality and data protection, in order to protect the privacy of personal information obtained through its application.

12.2 Applicable Law and Jurisdiction

The general conditions governing the use of BUEN TAXI are governed by the laws of the Republic of Colombia.Any dispute or conflict that may arise between the User and BUEN TAXI, for the entry and / or use of the site and the services provided therein, shall be brought before the judges of the Republic of Colombia and shall be resolved in accordance with the laws of the Republic of Colombia without giving effect to the conflict with other laws of other countries or their current state of residence.

For any legal or judicial effect, the place of these conditions is the city of Santa Marta, Republic of Colombia, and any controversy arising from its interpretation or application shall be submitted to the judges of the Republic of Colombia.
